DMCA Policy

Sharksnip respects intellectual property rights and complies with the Digital Millennium Copyright Act ("DMCA"). This policy describes how to submit copyright infringement notices and how we respond.


Designated agent

Pursuant to 17 U.S.C. § 512(c), our designated agent for receiving DMCA notices is:

How to submit a takedown notice

If you believe content on Sharksnip infringes your copyright, send a written notice to our designated agent containing:

  1. Your contact information — full legal name, address, telephone, email
  2. Identification of the copyrighted work — the work you claim is being infringed (or a representative list if multiple works)
  3. Identification of the infringing material — sufficient detail for us to locate it (URL, model name, creator username)
  4. Statement of good faith belief that the use is not authorized by the copyright owner, agent, or law
  5. Statement under penalty of perjury that the information is accurate and you are authorized to act on behalf of the copyright owner
  6. Physical or electronic signature of the copyright owner or authorized agent

False claims have legal consequences. Knowingly submitting a false claim of infringement may result in liability for damages, including attorneys' fees and costs.

Our response

Upon receipt of a valid DMCA notice, we will:

  • Remove or disable access to the allegedly infringing material expeditiously
  • Notify the user who posted the material
  • Forward the takedown notice to the user (with your contact information)
  • Document the action for our DMCA log

We may, at our discretion, suspend or terminate accounts of users who are subject to repeated valid takedown notices ("repeat infringer policy"). See section below.

How to submit a counter-notice

If you believe content was wrongfully removed, you may submit a counter-notice containing:

  1. Your contact information — full legal name, address, telephone, email
  2. Identification of the removed material and its location before removal
  3. Statement under penalty of perjury that you have a good faith belief the material was removed by mistake or misidentification
  4. Consent to jurisdiction — submission to the jurisdiction of the federal district court for the judicial district where you reside (or if outside the US, the Northern District of California)
  5. Statement that you will accept service of process from the original complainant or agent
  6. Physical or electronic signature

Send counter-notices to the same designated agent listed above.

If we receive a valid counter-notice, we will:

  • Forward it to the original complainant
  • Wait 10-14 business days; if the complainant does not file a court action seeking restraining order, we will restore the removed content

Repeat infringer policy

Sharksnip terminates accounts of users determined to be repeat infringers. "Repeat infringer" generally means:

  • 3+ valid DMCA takedowns affirmed in a 12-month period, OR
  • 1 court-confirmed willful infringement, OR
  • Patterns of bad-faith activity demonstrated by repeated counter-notices that themselves are abusive

Account termination forfeits:

  • Pending creator payouts (subject to legal obligations to pay legitimate amounts owed)
  • Earned credit balances
  • Marketplace listings (refunds to buyers may be issued at our discretion)

Reinstatement is at our sole discretion and generally requires demonstrated remediation.

Trademark complaints

For trademark infringement (vs. copyright), use the same designated agent and process, with appropriate adaptations of the elements (e.g., trademark registration number instead of copyrighted work).

Right of publicity / NIL complaints

For complaints involving rights of publicity, athlete name/image/likeness (NIL), or similar non-copyright IP claims, contact:

We will review and act in accordance with applicable law.

Transparency

We will publish an annual transparency report (after reaching 10,000 paying users) summarizing:

  • Total DMCA notices received
  • Total takedowns executed
  • Total counter-notices received
  • Total content restored
  • Total accounts suspended or terminated for repeat infringement
